Website and Evaluation Terms of Use

1. Agreement and scope

These Terms of Use govern access to mezopix.com, its public content, request forms, and any free, time-limited MEZOPIX evaluation made available through the website. By using the website, submitting an evaluation request, or accessing an evaluation, you agree to these Terms. If you act for an organization, you represent that you are authorized to accept these Terms for that organization. A separate written agreement will govern any pilot, paid service, customer data processing, or production deployment.

2. Informational website

The website describes MEZOPIX LLC, its current product direction, and products or capabilities that may be prototypes, private MVPs, in development, or planned. Website content is general information, not professional advice, a binding offer, a guarantee of results, or a commitment to deliver any feature, service level, or product.

3. Evaluation requests and access

You must provide accurate business information and may request access only for legitimate internal business evaluation. Submission does not guarantee approval. MEZOPIX may approve, deny, limit, monitor for security, suspend, revoke, or allow access to expire at its discretion. Evaluation links are personal to the approved recipient, may not be shared, and normally expire one hour after activation.

The evaluation provides decision support only. Results may be incomplete, approximate, or incorrect and require qualified human review before purchasing, specifying, installing, or using any product.

4. Your information and materials

Do not submit confidential catalogs, trade secrets, regulated data, payment-card data, health information, government identifiers, export-controlled information, or other sensitive information through the public website or evaluation request form. Enter only product descriptions that you are authorized to use for evaluation. Information submitted through the request form may be used to review the request, communicate with you, secure the evaluation, and maintain business records consistent with MEZOPIX data-handling notices.

5. Acceptable use

You may use the website and approved evaluation only for lawful business evaluation. You may not:

• share credentials or access links, bypass time limits, or access administrative or nonpublic areas;
• scrape, harvest, bulk-query, copy, extract, download, reconstruct, or create a substitute for any catalog, dataset, model, ranking method, or system;
• reverse engineer, probe, benchmark for publication, security test, interfere with, overload, or introduce malicious code into the website or evaluation;
• use outputs as the sole basis for safety-critical, engineering, purchasing, or compliance decisions; or
• violate applicable law, third-party rights, or another person’s privacy or confidentiality.

6. Ownership and limited permission

MEZOPIX and its licensors retain all rights in the website, branding, designs, software, workflows, evaluation experience, synthetic demonstration data, and other content. MEZOPIX grants you a limited, revocable, nonexclusive, nontransferable permission to view the public website and, when approved, use the evaluation during the authorized period for internal assessment. No other license or ownership right is granted.

7. Feedback

If you voluntarily provide suggestions or feedback, you grant MEZOPIX a worldwide, perpetual, irrevocable, royalty-free right to use and incorporate that feedback without restriction or payment. This section does not give MEZOPIX ownership of your confidential information or proprietary catalog data.

8. Third-party services and links

Third-party websites, infrastructure, or services are governed by their own terms and policies. MEZOPIX does not control and is not responsible for third-party content, availability, security, or practices.

9. Disclaimers

To the maximum extent permitted by law, the website and free evaluation are provided “as is” and “as available.” MEZOPIX disclaims all express and implied warranties, including merchantability, fitness for a particular purpose, title, noninfringement, accuracy, availability, and security. MEZOPIX does not warrant that results will be complete, error-free, suitable for a particular application, or continuously available. Rights that cannot lawfully be excluded remain unaffected.

10. Limitation of liability

To the maximum extent permitted by law, MEZOPIX LLC and its officers, personnel, contractors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, revenue, business opportunity, or goodwill arising from the website or free evaluation. MEZOPIX’s aggregate liability arising from the website or free evaluation will not exceed one hundred U.S. dollars. This limitation does not apply where liability cannot lawfully be limited.

11. Responsibility for misuse

You are responsible for your use, submissions, and any violation of these Terms. To the extent permitted by law, you will defend and indemnify MEZOPIX against third-party claims, damages, and reasonable costs arising from your unlawful use, unauthorized materials, infringement of third-party rights, or material violation of these Terms.

12. Suspension and termination

MEZOPIX may suspend or terminate access when reasonably necessary to protect the company, users, systems, intellectual property, or third parties, or when these Terms are violated. Provisions concerning ownership, feedback, disclaimers, liability, responsibility for misuse, governing law, and interpretation survive termination.

13. Governing law and disputes

These Terms are governed by Texas law, without regard to conflict-of-law rules. Subject to any nonwaivable legal rights, courts located in Tarrant County, Texas will have exclusive jurisdiction over disputes arising from these Terms or the website. Before filing a claim, each party will make a good-faith effort to resolve the matter through written notice and discussion.

14. Changes and interpretation

MEZOPIX may update these Terms by posting a revised version and effective date. Continued use after the effective date constitutes acceptance of the revised Terms. If a provision is unenforceable, it will be modified only as necessary and the remaining provisions will continue. Failure to enforce a provision is not a waiver. These Terms, together with any notices expressly incorporated here, are the entire agreement governing the public website and free evaluation.
